Dave,

Did the trial take place at the end of March or was it postponed again?

Hi, Chris

The trial started Tuesday, March 30th and ran through Friday, April 2nd. It was very detailed discussing approved procedures, data, specifications and standards for repair on the fuel value. Observing as I did, I felt that Ed, Webco's attorney, did a good job representing Bob and John. The judge had another case he had to go to and said this trial would reconvene on April 27th and he would give a decision then. The only issue discussed at this trial was the fuel value. Personally I think (hope) the judge will rule in Webco's favor, but we need to keep in mind that there are other charges to contend with. The good news is that some of the other charges have already been dropped. The next trial date is set for June 2nd and as I understand it and will be a civil case dealing with the gear transmission and motor. However, Ed said he wouldn't be surprised if the June 2nd date was moved. The really sad part of all this is, win lose or draw, Bob and John ultimately lose. The end result is two or more years of stress, aggravation and financial devastation. I think the letters written by our members and various FBO's around the world were helpful. Only time will tell. :-)

Is this a Jury trial or a Court trial ?

Hi Jeff,

This is a court trial with an aviation federal judge presiding. I previously asked the same question to Ed, Webco's attorney, and he said it's much better this way. After attending this trial I can see that he is correct. This type of trial is very technical and detailed and would in most cases go beyond the average juror's area of understanding. I'm very anxious to hear the judge's decision at the end of April.

Interesting, arguments can be made for both types of trials.

A jury trial with something like this would be a bad thing. A jury that is afraid of aircraft, as most are, wouldn't see beyond the fact that regulations may have been broken. On the other hand, if you have a bad Administrative Law Judge, you are no better off, with no hope. Fortunately, Webco is not on the west coast. The ALJ out here is noted for not being sympathetic to the defendant.

I posted the following under current news awhile ago. I suppose I should have posted it here also.

Webco Trial Update - Posted-05/18/2010
Due to the length of the trial and the substantial amount of Documentary evidence the, judge is giving the Prosecution FAA) 45 days to compile a written brief outlining their charges against Webco. In turn, Webco (the Respondent) will have 45 days to answer back. After that the FAA will have 15 days to counter and then the judge is supposed to make a ruling. That should bring a decision around the end of September. It has been a long hard road for Bob Weber and John Regier and hopefully the verdict will be a victory them (and all Comanche owners as well.) Unfortunately, there are no real winners in an ordeal like this. It's been more than two years of aggravation, stress and financial devastation. Bob and John have expressed their sincere appreciation to ICS's for their support in this difficult trial.
