Are you practicing law without a license again?

Your implication is that the mechanic does not have a "legal" claim. This is in error, in most jurisdictions of which I am familiar, and I am reasonably certain that it would be that way in Arizona. Typically, a mechanic's lien is superior to a mortgage claim.

The mechanic may be under the same, erroneous assumption under which you seem to be laboring. I hope you have not been encouraging the mechanic to think that his claim has no legal standing, and thus should take what he can get.

Be careful about the assumptions you make, especially when you are operating out of your area of licensed expertise.

My mistake. Again. My only license is to fly an airplane and to drive a car. Neither of which I do very well. Kevin Klein is the contact with the mechanic. He's not a lawyer either. Maybe you should advise him. His phone is 928 284 1005.

I am not licensed to practice law in Arizona, so my calling him could be seen as soliciting a client, whom I am licensed to represent. The mechanic should seek advice from a local attorney, before giving up half of what you represented to be a $20K bill. If the mechanic is good at understanding regulations, etc., he can probably answer the question by doing a little research on Arizona law, on the internet.

If someone contacts me, I can at least point them in the right direction and cannot be accused of soliciting outside my jurisdiction.

To Dave Pyle and All,

Dave, In your private post to me you mentioned you had already posted a postponement of the auction date and my post was redundant.

But, you did not mention the starting price, the bank or mechanics lien.

You also said, obviously I had different information than you had. I guess I have.

Dave, I just posted what I was told by Kevin.

I am not acting as a agent, broker or in any way involved with sale or purchase of this aircraft.

Not that it makes a difference but, yes, we have the same information most of which was covered in prior posts. Kevin and I belong to the Meyers owner's group. I know him well.

Wow, I didn't know you owned a Myers and belonged to there club. What type of Myers and how much time do you have in them ? It sounds very interesting.

David Pyle started a new thread.
Kevin Klein in Sedona reports that the delayed auction of the 400 (posted earlier) is on hold. The new starting bid will be $60K. Airframe logs and access to the airplane are still being disputed. He will update information as available.

My preference would be to keep it all in this one.
At $60,000 starting bid, it's getting interesting again.

You just did, by again posting in this subject - except for giving it a new subject name. Most posters don't bother copying the original subject name, as I usually do.

How do you have a sherriff's sale with a minimum bid?

I thought that it sells for what it will bring. Luckily, I have almost no experience with such things.

Apparently the minimum starting bid is what it will take to clear the liens, and sale costs.

You are correct. The lien holder will take $50K to settle and the mechanic will take $10K. This is agreed. No word when the "auction" will be.
